COMMISSIONS

Fruity Flock Ltd only accepts art commissions that fall under the avian theme e.g. parrots, corvids and other birds. Any art commission request that fall outside of that may risk being rejected.

Charges for services to be provided by Fruity Flock Ltd are defined in the price quotation that the Client will receive via email or text messaging via social media. Quotations are valid for a period of 14 days. Fruity Flock Ltd reserves the right to alter or refuse to honour a quotation after expiry of the 14 days.

The Client may be required to provide suitable photographs for the commission art piece to be produced. The Client must have permission to use such photographs & it is their responsibility to not breach any copyright laws.

Once work commences on a Clients commission, Fruity Flock Ltd will email the first drafted designs of the art commission. The drafts will consist of 3-4 uncoloured sketches that are drawn based on either the Client’s requirements or the Client’s description of the bird.

The Client will be allowed to select one draft out of the few designs and request for minor alterations to its design content.

Fruity Flock Ltd reserves the right to share “painting in progress” photos to social media unless the Client expresses this not to be done. eg a surprise present.

Once the art commission is complete Fruity Flock Ltd will email the Client a watermarked digital photo of the finished commission piece. Only very minor adjustments can be made in this stage.

Fruity Flock Ltd retains the copyright to the art commission created from the Clients photo.

Fruity Flock Ltd reserved the right to display the art commission on their website, social media pages and online public spaces. If a Client is unhappy about the art commission being displayed, they must declare this upon placing the art commission.

The Client may share the art commission on social media pages.

The art commission is strictly prohibited from being sold or distributed whether physically or digitally which includes, but not limited to, digital marketplaces, NFT sites, on-demand services.

If the client wishes to obtain distribution rights then a Copyright Transfer Agreement must be signed upon discussion and agreement with Fruity Flock Ltd.

Payment for the art commission will be in British Pound (£).

Fruity Flock Ltd requires a non-refundable 50% deposit from the Client to confirm a commission slot, which may or may not start immediately upon payment.

An invoice will be issued via email by Fruity Flock Ltd for the full payment in which the Client is only required to pay the initial 50% deposit. Invoice will expire after 10 working days if no payment has been made. In the event an invoice expires, a new invoice will have to be issued.

Should the quotation expire upon the new issuance of an invoice, an extension to the original quotation or a new quotation will be provided at the discretion of Fruity Flock Ltd (Refer to Price Quotations terms)

The full payment must be paid upon completion of the art commission & before collection.

Once the art commission piece has been completed and delivered to the Client, the art commission would be non refundable and non changeable.

Please note, unless specifically agreed to by both parties prior to the issuing of an invoice, Fruity Flock Ltd does not accept payment in parts or via instalments.

If the client chooses to terminate the services of Fruity Flock Ltd after agreeing a commission arrangement but before the commissioned project is complete, Fruity Flock Ltd reserves the right to retain any non-refundable deposits paid.

Should the Client cancel the commission agreement after the art commission has been completed but yet to be delivered, Fruity Flock Ltd reserves the right to retain any non-refundable deposits paid, distribute, reproduce and sell the art commission as a product on their website.

If communication breaks down on the part of the Client for a period of 30 days (that is, the Client fails to reply to a communication from Fruity Flock Ltd, ) Fruity Flock Ltd will issue a warning email. If this warning email is not replied to (and communication does not resume) within the following period of 30 days, Fruity Flock Ltd reserves the right to terminate the commission. In this event, all deposits paid will be retained by Fruity Flock Ltd and the commission will be cancelled.

If communication mishaps such as rude or inappropriate behaviour or a breach of terms of service on the part of the Client happens, Fruity Flock Ltd reserves the right to cancel the commission without providing a refund.

If the Client wishes to recommission at a later date they will be required to request a new project quotation, sign a new Commission Agreement and pay a further non-refundable deposit.
